The short version — we want you to create amazing things with Fuser. Here are the basics:

  • Your content is yours. You own what you upload and what you create. We take only the narrow license we need to store, process, and display it back to you and the people you choose to share it with.
  • Your content is confidential. We treat your projects and content as your confidential information. We don't train AI models on it, and we don't let our AI providers train on it either.
  • Play nice. Don't use Fuser for anything illegal, harmful, or that violates others' rights.
  • Teams are first-class. Organizations can manage members, content, and billing — with the controls a business expects.
  • We're building something great. The service will change as we improve it. If a change materially affects you, we'll tell you first.

The following terms and conditions (the "Agreement") govern all use of the Fuser website, application, and API (together, the "Service") provided to you by Fuser Technologies, Inc. ("Fuser," "we," "our," or "us"). By using or accessing any part of the Service, you ("User," "you") agree to all of the terms and conditions contained herein.

Changes to These Terms

We may modify this Agreement from time to time. If a change is material, we will notify you before it takes effect — by email to the address on your account and/or by prominent notice in the Service. For paying subscribers, material changes take effect at the start of your next subscription period; for everyone else, changes take effect upon posting. The "Last updated" date at the top of this page always reflects the current version, and because these terms are maintained in our public website repository, a complete change history is available on request. If you do not agree to a change, you may stop using the Service and, if you are a paying subscriber, cancel your subscription before the change takes effect.

Scope of the Service

The Service is a multimodal content creation and collaboration platform. It allows users to generate, create, organize, and share text, images, audio, video, 3D models, animations, and other creative content using AI-powered tools and traditional creative workflows.

Eligibility, Registration & Account Security

You certify that you are at least 13 years of age (or have the consent of a legal guardian if 13 is under the age of majority in your jurisdiction) and that you are legally permitted to use the Service. This Agreement is void where prohibited by law.

As a condition to using the Service, you may be required to register and select a password and username. You agree to provide accurate, complete, and updated registration information. You may not register using a name or trademark of another person or entity with intent to impersonate them. You are responsible for maintaining the confidentiality of your credentials and for all activity on your account. Notify us immediately at support@fuser.studio if you believe your account has been compromised.

Teams & Organizations

Fuser supports organizations, teams, and shared workspaces ("Organizations").

Authority to bind. If you create or administer an Organization, or accept this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and "User" refers to that entity.

Organization content and control. Content created within an Organization's workspaces belongs to the Organization (as between Fuser and the Organization). Organization administrators can manage members, roles, and access to Organization workspaces, including removing members. When a member leaves an Organization, content in the Organization's workspaces remains with the Organization; the member's personal (non-Organization) projects remain their own. Organization administrators do not gain access to a member's personal projects outside the Organization.

Billing entity. Organization subscriptions are billed to the Organization. Personal subscriptions are billed to the individual account holder.

Data protection. Organizations on eligible plans may execute our Data Processing Agreement. Our current service providers are listed on the Sub-Processors page.

Your Content

The Service permits you to create, generate, upload, and organize text, images, audio, video, 3D models, animations, and other creative content ("User Content").

Ownership. As between you and Fuser, you own your User Content. Nothing in this Agreement transfers ownership of your User Content to Fuser.

License to Fuser. You grant Fuser a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as transcoding and thumbnails), display, perform, and distribute your User Content solely as necessary to provide the Service to you and to the users you authorize through your privacy and sharing settings. This license does not permit Fuser to use your User Content for any other purpose, and it terminates when your User Content is deleted from the Service, except for limited periods required for backups and legal compliance.

Visibility. Your projects are private by default. User Content is accessible to other users or the public only as you (or your Organization's administrators, for Organization workspaces) configure through privacy and sharing settings.

Your responsibilities. You are responsible for your User Content. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to your User Content and that it does not violate the law or the rights of any person or entity, including intellectual property, privacy, and publicity rights.

Confidentiality

Fuser will treat your non-public User Content as your confidential information. We will not access, use, or disclose it except: (a) to provide, secure, and maintain the Service; (b) as you direct or authorize through the Service's sharing features; (c) to comply with applicable law or a valid legal process; or (d) to enforce this Agreement or protect the rights, property, or safety of Fuser, our users, or the public. Internal access to User Content is restricted to personnel who need it for the purposes above and who are bound by confidentiality obligations. We may use aggregated, de-identified usage data (which does not include the substance of your User Content and cannot reasonably be linked to you) to operate and improve the Service.

AI Features, Inputs & Outputs

The Service includes generative AI features. "Input" means content you provide to an AI feature (prompts, reference media, project context); "Output" means content an AI feature generates in response. Input and Output are both your User Content.

Ownership of Output. As between you and Fuser, you own all right, title, and interest in and to Output, and Fuser hereby assigns to you any rights it may have in Output. Your ownership and use of Output may additionally be subject to the terms of the third-party model provider that generated it and to applicable law.

No training on your content. Fuser does not train AI models on your User Content, and Fuser does not permit the third-party AI providers we use to include your User Content in their training data.

Third-party models. AI features are powered by third-party model providers, listed on our Sub-Processors page. Your Input is transmitted to the relevant provider only when you invoke a feature that uses it.

Output characteristics. Generative AI is probabilistic. Output may be inaccurate, incomplete, or similar to output generated for other users, and Fuser does not warrant that Output is unique, accurate, or non-infringing. You are responsible for reviewing Output before relying on or distributing it, and for ensuring your use of Output complies with applicable law and third-party rights.

Acceptable Use

You shall not, nor permit anyone else to, directly or indirectly: (i) reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code or underlying algorithms of the Service (except to the limited extent such restrictions are prohibited by law); (ii) modify or create derivatives of any part of the Service; (iii) rent, lease, or resell access to the Service without our written permission; (iv) remove or obscure proprietary notices; (v) attempt to circumvent usage limits, rate limits, or billing mechanisms; (vi) engage in unauthorized scraping, crawling, or bulk downloading of content from the Service; or (vii) interfere with the security or integrity of the Service.

In connection with User Content, you agree not to submit or generate material that: is unlawful, defamatory, or fraudulent; is sexually exploitative of minors or otherwise exploits or harms minors; constitutes harassment or credible threats; infringes the intellectual property, privacy, or publicity rights of others; constitutes spam or unauthorized advertising; impersonates another person; or violates the acceptable-use terms of the underlying AI providers.

Our Community Guidelines describe these expectations in more detail, including NSFW content marking and our moderation and appeals process. Fuser may remove User Content that violates this Agreement and may suspend or terminate accounts as described under Termination below.

Fees & Billing

If you purchase a paid subscription ("Paying Subscriber"), you agree to pay the fees described at the time of purchase. Payment is processed by our payment processor (Stripe); we do not store your full card details. Subscriptions renew automatically for successive periods of the same duration at the then-current rate unless cancelled before the renewal date. We will notify you in advance of price increases, which take effect at your next renewal.

Usage-based features. Certain features consume credits based on usage (e.g., AI generation). You are responsible for monitoring usage. Credits are non-refundable except as required by law.

Refunds. Subscription fees are generally non-refundable, but we may provide refunds at our discretion for unused subscription periods if requested at support@fuser.studio within 30 days of payment.

You are responsible for all taxes associated with your use of the Service other than taxes based on Fuser's net income.

Support

All users may contact support@fuser.studio. Paying Subscribers receive priority email support. Organizations on Team and Enterprise plans receive a dedicated Slack channel with Fuser staff and a first-response target of 24 hours on business days. Enterprise customers may negotiate additional support commitments in an order form or master agreement.

Privacy & Data Protection

Our Privacy Policy describes how we collect and process personal data and is incorporated into this Agreement by reference. Our current service providers and AI model providers are listed on the Sub-Processors page. Where Fuser processes personal data on behalf of an Organization, our Data Processing Agreement applies as described there. Common data-protection questions are answered in the Privacy FAQ.

Fuser's Intellectual Property

As between the parties, Fuser owns all title, ownership rights, and intellectual property rights in and to the Service (excluding your User Content), including software, design, and content provided by Fuser or its partners. Except as expressly authorized, you may not copy, distribute, sell, or create derivative works from such materials. If you provide feedback or suggestions, you grant Fuser a perpetual, irrevocable, royalty-free license to use them without restriction.

Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice containing the following to dmca@fuser.studio:

  1. Identification of the work or material being infringed;
  2. Identification of the allegedly infringing material, including its location on the Service;
  3. Your name, address, telephone number, and email address;
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or law;
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner;
  6. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

We respond to valid notices, including by removing infringing material, and terminate the accounts of repeat infringers.

Termination

By you. You may stop using the Service and delete your account at any time. Before deleting your account, you can export your User Content using the Service's export features.

By Fuser. We may suspend or terminate your access immediately if you materially breach this Agreement, if required by law, or to address a security risk. For any other reason, we will provide Paying Subscribers at least 30 days' notice before termination and a pro-rata refund of prepaid fees covering the period after termination.

After termination. For 30 days following termination of a paid account (other than termination for material breach), we will make your User Content available for export on request to support@fuser.studio. Thereafter we will delete User Content in the ordinary course, as described in our Privacy Policy. Provisions of this Agreement that by their nature should survive termination (including ownership, confidentiality, warranty disclaimers, and limitations of liability) survive.

Warranty Disclaimer

THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FUSER MAKES NO WARRANTY THAT (I) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, (II) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS, (III) AI-GENERATED OUTPUT WILL BE ACCURATE, UNIQUE, OR ERROR-FREE, OR (IV) THE SERVICE WILL BE AVAILABLE WITHOUT INTERRUPTION. THE FOREGOING DISCLAIMER SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EITHER PARTY BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL THEORY FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF FORESEEABLE. FUSER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100.00 (U.S.) OR THE FEES PAID BY YOU TO FUSER IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT GIVING RISE TO LIABILITY. THESE LIMITATIONS DO NOT APPLY TO A PARTY'S BREACH OF THE CONFIDENTIALITY SECTION, A PARTY'S INDEMNIFICATION OBLIGATIONS, OR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify, and hold harmless Fuser, its affiliates, and each of their employees, contractors, directors, suppliers, and representatives from all third-party claims and related liabilities and expenses, including reasonable attorneys' fees, that arise from: (i) your User Content; (ii) your violation of law or the rights of a third party; or (iii) your material breach of this Agreement.

Governing Law & Disputes

This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the parties submit to the exclusive jurisdiction and venue of the state and federal courts located in California. Before filing a claim, each party agrees to attempt in good faith to resolve the dispute informally by contacting the other party (for Fuser: legal@fuser.studio).

Miscellaneous

The failure of either party to exercise any right provided for herein is not a waiver of further rights. If any provision of this Agreement is found unenforceable, it will be limited or eliminated to the minimum extent necessary so that the Agreement otherwise remains in full force and effect. You may not assign this Agreement without Fuser's prior written consent; Fuser may assign this Agreement in connection with a merger, acquisition, or sale of assets with notice to you. This Agreement, together with the documents it incorporates by reference, is the complete and exclusive statement of the mutual understanding of the parties regarding its subject matter.
